General Terms and Conditions (GTC) of NORMOX, Owner: Tim Barth
Part A – General Provisions
§1 Scope and Definitions

These General Terms and Conditions apply to all contracts for the sale and rental of altitude generators between us and a consumer or business (hereinafter referred to as "Customer") in the version valid at the time of the conclusion of the contract.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A business is any natural or legal person or partnership with legal capacity who, when entering into the contract, acts in exercise of their trade or profession.

Any terms and conditions deviating from these GTC shall not apply unless we explicitly agree to them in writing.
§2 Conclusion of the Contract, Storage of Contract Text

Contracts can be concluded via remote communication means (e.g., email, telephone) or through the online shop (http://www.normox.com).

Orders via remote communication means:
If a customer requests an offer via email, telephone, or other remote means, we will provide a binding offer including all relevant information. The contract is concluded when the customer explicitly accepts the offer within the specified period or by making payment. -
Orders via the online shop:
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to submit an offer. The customer submits a binding offer by completing the order process.
The order process involves the following steps:

Selection of the desired product or rental option

Clicking the “Buy now” or “Rent now” button

Entering customer information

Reviewing and correcting the entered information, if necessary

Acceptance of the GTC and the withdrawal policy

Binding submission of the order by clicking the “Submit” or “Buy” / “Rent” button
After receiving the order, we will send an order confirmation by email, thereby accepting the customer's offer.
Storage of Contract Text: The GTC can be viewed at any time at https://www.normox.com/de/agbs-und-widerrufsbelehrung. For security reasons, order data is not stored permanently online.
§3 Customer's Right of Withdrawal (for Distance Contracts)
Customers have a right of withdrawal under the following conditions (applicable for both purchase and rental contracts):
Withdrawal Instructions:
You have the right to withdraw from this contract within 14 days without providing any reason. The withdrawal period begins, in the case of purchase contracts, on the day you or a third party designated by you take possession of the goods. For rental contracts, the withdrawal period begins with the conclusion of the contract.
To exercise the right of withdrawal, a clear statement (e.g., email or letter) must be sent to:

Consequences of Withdrawal:
If you withdraw from this contract, we will refund all payments received, including standard delivery charges, without undue delay and no later than 14 days from the day we receive notice of your withdrawal. Refunds will be made using the same payment method used for the original transaction, unless explicitly agreed otherwise.
For purchase contracts, we may withhold the refund until we have received the returned goods or proof of return has been provided. The customer bears the cost of returning the goods.
§4 Safety Instructions and Usage

Devices must only be used according to the operating manual and application guidelines.

Individuals with health conditions are advised to consult a doctor before use.

We are not liable for damages resulting from improper use.
§5 Liability

We are fully liable for damages resulting from injury to life, body, or health caused by intentional or negligent breach of duty.

In all other cases, liability is limited to intent and gross negligence. For slight negligence, we are liable only for breaches of essential contractual obligations (“cardinal obligations”), but only for foreseeable and typical contractual damages.
§6 Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If the customer is a merchant, legal entity under public law, or special fund under public law, the place of jurisdiction is our business location.

If any provision of these GTC is invalid, the remaining provisions shall remain unaffected.
Part B – Special Conditions for Purchase
§7 Prices, Shipping Costs, Payment, Due Date

All prices include statutory VAT and are subject to shipping costs.

Unless otherwise agreed, a deposit of 50% of the purchase price is due upon contract conclusion. The remaining amount must be paid before or upon delivery.
§8 Delivery

Delivery is made to the address specified by the customer within 50 working days after receipt of payment or conclusion of the contract.

The risk of accidental loss or deterioration passes to the customer only upon delivery.
§9 Retention of Title
The goods remain our property until full payment has been received.
§10 Warranty (Purchase)

Statutory warranty rights apply.

For businesses, the warranty period is limited to 12 months from delivery, except for damages resulting from injury to life, body, or health or in cases of intent or gross negligence.
Part C – Special Conditions for Rental
§11 Rental Object and Rental Period

The rental object is the altitude generator specified in the contract, including accessories.

The rental period is contractually agreed. It begins on the date of delivery or provision and ends upon proper return.

Any extension of the rental period requires written agreement.
§12 Rental Payment and Security Deposit

The rental fee must be paid in advance for the entire rental period, unless otherwise agreed.

The lessor may require a reasonable security deposit to cover potential claims arising from the rental. It will be refunded after return and inspection of the rental object.
§13 Return and Condition

The renter is obliged to return the rental object at the end of the rental period in clean and fully functional condition.

Any damage or defects must be reported immediately. The renter is liable for damage or loss unless caused by normal wear and tear.
§14 Use, Maintenance, and Safety

The rental object may only be used for its intended purpose and in accordance with the operating manual.

Subletting or transferring to third parties is not permitted without prior written consent.
-
Maintenance and repair work may only be carried out by the lessor or an authorized professional.
§15 Renter’s Liability
The renter is liable for all damage to the rental object during the rental period unless caused by normal wear and tear.
§16 Termination and Early Termination

Ordinary termination during the agreed rental period is excluded.

The right to extraordinary termination remains unaffected.
